Divorce, Custody & Family Law

Ohio Family Law Attorneys

Divorce, dissolution, custody, child support, parenting time, post-decree modifications, and protective orders. Discreet, results-focused representation in Lawrence, Scioto, Gallia, and Jackson Counties.

Family Law in Southern Ohio

Family-law matters are different from every other kind of legal work. They are emotional, time-consuming, and often play out over months or years across multiple court appearances and sometimes multiple courts. The relationships at stake — with a spouse, with a co-parent, with children — do not end when the final entry is filed.

The firm's family law practice is led by Mark K. McCown. Mark handles divorce, dissolution, custody, support, and post-decree modifications across Lawrence, Scioto, Gallia, and Jackson Counties — with the disciplined preparation that the firm's broader civil practice demands and the personal attention that family-law clients need.

Matters We Handle

Divorce & Dissolution

Ohio recognizes two paths to ending a marriage: divorce (adversarial, based on grounds, with a contested process if needed) and dissolution (collaborative, by mutual agreement, with a single hearing). The right path depends on whether the parties can agree on the four key issues: division of assets and debts, spousal support, allocation of parental rights and responsibilities, and child support. We help clients evaluate which procedure fits their situation and the likely cost of each.

Custody & Allocation of Parental Rights

Ohio law uses the term "allocation of parental rights and responsibilities" rather than "custody," and the analysis is built around the best interests of the child standard in R.C. §3109.04. The court considers the child's wishes (when age-appropriate), the parents' wishes, the child's relationships with each parent and with siblings, the child's adjustment to home/school/community, the mental and physical health of all parties involved, and a list of additional factors. We prepare clients to present the strongest possible case under that standard.

Child Support & Spousal Support

Child support in Ohio is calculated under the statutory worksheet (R.C. §3119), with deviations available where appropriate. Spousal support is more discretionary and turns on the factors in R.C. §3105.18. We work through both calculations carefully and identify where deviations or modifications make sense.

Parenting Time & Visitation

Parenting-time schedules are highly fact-specific — long-distance parents, irregular work schedules, special-needs children, infant and toddler graduated parenting time, holidays, summer breaks, and travel arrangements all have to be addressed. We are willing to litigate — through pretrial motions, contested hearings, and trial when necessary — to pursue the parenting-time outcome the client wants.

Post-Decree Modifications

Custody, parenting time, child support, and (less commonly) spousal support can all be modified post-decree where there has been a "change of circumstances." Common triggers: a parent's relocation, a job change, a new partner, the children's evolving needs, or non-compliance with the existing order.

Protective Orders

Civil protection orders (CPOs) and Stalking / Sexually Oriented Offense protection orders (SSOOPOs) are available where there has been domestic violence or stalking. We represent both petitioners (those seeking the order) and respondents (those defending against it). The hearings are fast-moving and the consequences — for housing, employment, custody, and gun rights — are significant.

Adoption

Stepparent adoption, agency adoption, and private placement adoption. Ohio's adoption procedure has specific consent and waiver requirements that we walk clients through.

How a Family-Law Case Works

  1. Initial Consultation. A confidential discussion of what's happening, what your goals are, and what realistic outcomes look like.
  2. Engagement & Strategy. If we're the right fit, we agree on the scope of representation and a fee structure (most family-law work is hourly with a retainer; some uncontested matters are flat-fee).
  3. Filing & Service. We file the complaint or petition and arrange service on the other party.
  4. Discovery & Negotiation. Financial disclosure, document exchange, parenting-time discussions, and (where possible) settlement talks.
  5. Mediation. Many counties require mediation before trial; we prepare you for it and represent you through it.
  6. Trial. If the case doesn't settle, we take it to trial. Family-law trials are usually bench trials before the assigned judge or magistrate.
  7. Final Entry. The court signs the final decree. We make sure the language reflects what was negotiated or ordered.

What to Bring to the Consultation

If you're consulting on a divorce or dissolution: a list of major assets and debts, recent tax returns, recent paystubs (yours and your spouse's if available), a list of bank accounts and investment accounts, and any existing court orders. If you're consulting on a custody matter: copies of any existing orders, the children's school information, and a brief written summary of the parenting situation.

Schedule a Consultation

Family-law matters are time-sensitive — not in the same way as a criminal case, but in the sense that delay rarely improves outcomes. Call (740) 532-8744 to schedule a initial consultation, or use the form below.
